I may be wrong here, but it seems to me that according to the rules, anyone can request a ban poll for someone, it is up to the admin/moderators to determine if it is a banable offense.

Since this is a member moderated community I wish to lay down ground rules for the banning of a user.

• PM sent to Admin. Admin will review.
• If Admin deems the situation to be a banable offence then a poll will be created in the Politics forum.
• The poll options will be as follows:
  • Permanent ban
  • 7 day suspension (some situations may warrant 30 days)
  • No ban
• A 51% majority must rule in favor of the ban.
• At least 10 senior members must vote in the poll for results to be valid.
• The poll will be open for voting for 24 hours.

Since cigarsarge made the poll, it seems fair to assume that he feels fishy has done something that is banable. It is now just up to the members here to agree or disagree - and I don't think the banning policy dictates that a ban vote requires a breaking of the rules.

Cigarsmokers.com is a friendly community of like minded brothers of the leaf. This is not the place to express derogatory views or remarks. Members making any statements based on race, religion, culture or sexuality are subject to being banned.

Note that hex says that those making derogatory remarks are not to be banned automatically, but are subject to banning. He also does not say that these are specific requirements for banning.

In my opinion, banning someone doesn't require that they have broken one of the rules - we as a community have the power to kick someone out if all that person is here to do is stink the place up with his irrelevant verbal diarrhea.

Based on the facts provided above, I can't justify banning Kendall.

I do question his intent of participation here - it seems the antics of the board could amuse him without him having the privilege of an account here - and would hope he would join this community as a participating member. If riling up members from time to time entertains him, that's fine with me. I don't have to respond.

I don't disagree with you completely Mark however I don't have the desire I used to to get into stupid debates online and if all you come here for is to start fires or help fan the flames then you just need to go away. If you're not here to participate and experience the brotherhood and camaraderie then you can just tip the fuck out the door imho.
