    Default Smoking in Private Establishments

    Here is a very logical and simple explanation of how banning smoking in bars is a violation of property owners rights. I miss the smell of a smokey bar or bowling alley...

    Been having this discussion around here lately. North Myrtle beach smoking ban went into effect this week. City council passed it 4-3. Votes are rarely decided by one on our city council. November would have been the time to let the people decide. It is only NMB city limits. Smoke shops were grandfathered and Nick's opened a cigar bar next to the store so I guess there's one public place to have a beer and a smoke.

    Grandfathered in until the lease is up.
    One here in Charleston lost the lease and now they have no where to go.

    Smoking is most definitely not banned indoors in Las Vegas. I'd wager it never will be either since it's completely against a casino's best interest to have customers forced to go outside to light up.

    Here in Canada smoking indoors is banned in all provinces as far as I know. I know for a fact it is here in Alberta and next door in Saskatchewan. In fact, my favorite B&M has a back room which he uses to allow "members" to use to smoke indoors. Yes, it's illegal and yes, he has been to court over this. It was decided in court (according to the owner) to not "punish" him and the police now leave him alone about it and turn a blind eye on the fact that he, and his customers, smoke in his place of business. They don't do it in front of the main window where passer's by can see, just in the back where he's turned it into a lounge.

    I guess it doesn't hurt that my little brother is a cop and also a "member" of his B&M and smokes indoors at every opportunity at the B&M

    What I don't get is, why should it be illegal for him, who's sole business is selling of tobacco (pipes) and cigars to smoke in his place of business if he wants to. Who's going to bitch about the smoke? No nonsmoker with a brain is ever going to walk into the store one would think. Regardless, I think it's nuts that a tobacconist can't legally have smoking in his place of business. Making that illegal was going to far as far as I'm concerned.

    Just for the record, I was a pack and a half (our packs in Canada are 25, not 20) a day smoker for over 30 years and quit just 3 yr's or so back. Honestly, I think it's right we aren't allowed to smoke in most public buildings. I'm quite sure most bar owners would be happy to have a choice to be smoking or nonsmoking and that's one business where I think they should have a choice. They problem is, the guys who would rather have their bar's be nonsmoking would lose money to the smoking bars and they know it so they're usually supporters of an outright ban on smoking in all bars.

    You know - I was watching a Ozzy Osbourne special last night - and then I open this thread to see "Eggs Ackley". I haven't seen "Eggs" in over 30 years!

    The late 60's, early 70's were a rather fun time for for me - so why do I now think I'm now on some sort of a crazy acid flashback even though I never took acid? What the heck does "Eggs" have to do with this thread?!?
