That's a great idea, sue the companies, get millions-billions of dollars for the state, put the companies in greater financial despair, which in turn cuts pensions and workers even more and reduces any R&D funds that would have been going to future alternative energy solutions. Companies can't spend money they don't have on R&D that's not guaranteed to bring immediate financial success, that's the luxury of companies with profits who aren't getting sued by idiots (this includes states as a whole). The implications of this case are way worse than the Microsoft case, though I believe that one was a whole heck of a lot stupider (the equivalent of telling Coke to package one Pepsi in every 6 pack).
