I may be wrong here, but it seems to me that according to the rules, anyone can request a ban poll for someone, it is up to the admin/moderators to determine if it is a banable offense.

Since cigarsarge made the poll, it seems fair to assume that he feels fishy has done something that is banable. It is now just up to the members here to agree or disagree - and I don't think the banning policy dictates that a ban vote requires a breaking of the rules.

Note that hex says that those making derogatory remarks are not to be banned automatically, but are subject to banning. He also does not say that these are specific requirements for banning.

In my opinion, banning someone doesn't require that they have broken one of the rules - we as a community have the power to kick someone out if all that person is here to do is stink the place up with his irrelevant verbal diarrhea.
