Oh, this is great!!! At StogieChat, they post this message about online retailers:

It has been noted lately that there have been some negative comments posted under some retailers advertisements in this section. I would ask you all to please refrain from posting the negative comments. If you have an issue with a retailer, please take it up with them privately via e-mail or private message. If you don't like someone's prices, simply don't buy from them.

We do not want to alienate the legitimate retailers who advertise here. On more than several occasions, members here have taken advantage of a sale or special that has been advertised here. Negative comments will drive away retailers and not allow us to take advantage of such deals.

Since many of the advertisers here post on other cigar forums as well, it is possible they could spread a negative word about StogieChat and it's members and undermine the friendly community we have built here over the past several years.
Positive comments and quetions to retailers regarding their products, services, shipping, etc, may be posted.

    Thank you

    The Admin Staff
And in that same admin's sigtag is the following quote:

Some people are like Slinkies. Not really good for anything, but they still bring a smile to your face when you push them down the stairs.

    Very friendly!!!

I am starting to understand why TBS came here to post... This was in one of the threads...

If there's any disappointments, it would probably be the small amount of business that drifts in to TBS-Cigars.com as a result of the forum (StogieChat).
I guess you would have to branch out to other cigar forums to peddle your cigars if you're not doing well on your own site...

Hey - but they do have Big Butt cigars!!!

Perhaps you should save the big boy threats for people that actually know what they are talking about. Slander is verbal, not written.

Not trying to post pad....But it looks like Shaggy has a point. If written words are slander then TBS should sue himself. He made himself and his company look very bad.

I'm seeing threads having to do with getting woman drunk and taking advantage of them!!! There is some pretty crude talk going on over at StogieChat. That is obscene and vulgar!!! And the site admin is allowing it!!! Uh-oh...

I better get my lawyer on it!!! I'll have to send an e-mail to the host letting them know StogieChat is in violation of their agreement with the site host!!!

Slander and libel only apply to untrue statements, not a statement of opinion.

For example, if I were to say "Walmart sucks, their prices are too high", which is a statement of opinion, and perfectly legal to say.

If I were to say "Walmart sucks, they use Chinese slave labor to manufacture their products", that would be libel. I would be using a falsehood to make Walmart look bad.

If a member said something like "SuperChuck is selling Swisher Sweets as Opus X -- DO NOT BUY" and it's untrue, THAT would be libel. If a member said "SuperChuck is a big fat jerk and he's ugly, don't buy his cigars", that would NOT be libel, as all those atatements are indeed true.
Well put and absolutely correct. I was about to post the same since I am an attorney and laughed when I read that dork's message. He knows just enough to think he is smart and to be a danger to himself and others.

He should consult an attorney, or at least a dictionary, before writing letters making claims and legal statements of which he has no knowledge. When you try to look smarter than you are you show others how stupid you can be. Stick to something you are good at pal . . . being an ass.

Wow, what a picture perfect example of how not to Make Friends and Influence People. If I were you I would take a Dale Carnegie class quick, of if you already have, ask for a full refund and an apology from Dale Carnegie Inc.

So buy a clue, bend over, and stick your head as far up yer rectum as it will fit.

LOL, Another forum I am a member of (not cigar realted at all) was threatened similarly to this, and was actually sued as a result. We won. In fact the company suing us were quite thoroughly embarassed in court by two of our own members, who happened to be lawyers. One of them was actually a first amemndment specialist.

*When using we/us etc, I am referring mostly to the site owner, who was the only one actually targeted by the suit. I wrote it this way because a lot of work went into the case by pretty much the whole forum, so we all partied when we won.

    Oh where do I begin?

TBSCigars is the site admin from StogieChat, a pathetic excuse for a cigar board that is dying a slow death due to the fact that the site admin does a piss poor job running his site.
TBSCigars posts "deals" on cigars here that he doesn't have (Padron 1926).
Another member and I call him on it.
He says "Oh they were sold yesterday."
TBSCigars was caught lying. This makes him mad and he gets nasty, defensive, arrogant and rude.
He adds to his site that he has a box of Padron 1926 #6 maduros.
Then all of a sudden he doesn't have them.
Oh and this is where it gets funny, HE CLAIMS I BOUGHT THEM!
I did not buy any cigars from this liar.
I doubt he ever had a box of Padron 1926 #6 maduros in the first place.
He then proceeds to post all kinds of personal information about me and my family on this site along with lies about talking to someone here in my house. Oh and TBS, you think you're not posting my phone numbers by excluding the prefix means that you didn't REALLY post them but since there is ONLY ONE PREFIX in the Hampton, CT exchange (455) for all intents and purposes, you DID INDEED post my phone numbers you lowlife. I'll bet if I posted your home phone number on a cigar BB, you'd lose your mind.
(Don't worry Hex, I won't sue you, I think it's rather comical that TBSCigars has no ethics and is a pathological liar and besides, most of the information he posted is a matter of public record so who cares. The stuff that he posted about claiming he talked to someone here at my house is an outright lie but if he wants to expose himself to a potential lawsuit, I'm more than happy to let him do just that ).

Now this liar is sending threatening messages to Hex that contain pure unadulterated fantasies and yet more lies.

This loser has serious issues and Hex, if you want to keep him around for the sheer entertainment value, that's fine with me! but personally, I would have banned this PIECE OF SHIT a long time ago. Entertainment value of liars and irrational trolls is one thing but when it disrupts the board to this level of ridiculousness, it's not worth it anymore.

My guess is that TBSCigars realizes he went way overboard lying about me buying cigars from him AND his posting of my family's personal information here on this board.

I would highly recommend NOT removing ANY posts because the only person who has exposed himself to potential legal problems is TBSCigars aka Eric Turner.

Typical arrogant, ignorant, blowhard loser liar trying to shout and intimidate his way out of the corner he's painted himself into.

Don't sweat it TBS, I have no desire to waste my time filing a frivilous lawsuit against you even though I have plenty of time on my hands, lots of lawyer friends and it might be fun just for the experience

fpdoc just had his balls cut off over on ClubStogie and shoved in his mouth so he'll be keeping his trolling head down. At least for a while anyway.....

TBS is hoping and praying that Hex will delete all his posts so he (TBS) won't get sued.

traffic nazi? Hmmmmmmmmm............I think he left, never to be heard from again.

    http://www.chillingeffects.org/trade...QuestionID=314

Question: Can an ISP or the host of the message board or chat room be held liable for defamatory of libelous statements made by others on the message board?

Answer: No. Under 47 U.S.C. sec. 230(c)(1): "No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider." This provision has been uniformly interpreted by the Courts to provide complete protection against defamation or libel claims made against an ISP, message board or chat room where the statements are made by third parties. Note that this immunity does not extend to claims made under intellectual property laws.

You know what? I'm not going to remove the posts in question. In the event that I do get a letter from an attorney I do have a plan of action as outlined by members of a community I frequent that caters to forum administrators. It's pretty good stuff too, the EFF loves this kind of situation.

Here are a couple more articles on the subject which I found useful in making my decision:
